A High Level committee meeting on Cadre Restructuring of Administrative Staff of All India Radio and Doordarshan was held on 29th December 2014 at Sastry Bhavan, New Delhi.  Officials from Ministry of I & B, DOPT and the President & General Secretary of ADASA participated in the meeting. Committee Members have heard the views of ADASA and the meeting was held in a cordial atmosphere. 

President and GS of ADASA requested all the Zonal Councils to send the Seniority List of all zones immediately.  Zonal councils are requested to mail the seniority list to vadrevu.srinivas@gmail.com.

WHERE DO WE STAND IN PRASAR BHARATI?

The present speaking order of the MIB in the Core professionals matter is an interesting stand of the Ministry of I & B on the matter of upgraded payscales.

Where is the department heading  ? and where has the NFADE taken all of us................more so, where do these particular 11 categories stand? 

1) Payscales granted to special 11 categories of employees for working in Prasar Bharati.

2) Fact remains  all are working in Prasar Bharati and will continue to work in PB without any alternative.

3) Benefits for working in Prasar Bharati surrendered by these 11 categories of employee under the banner of NFADE by demanding and allowing amending section 11 of Prasar Bharati Act.

4) Result  - All employees joined  before 05/10/2007 employees of Government of India on deemed deputation to PB with Govt pay scales and rules admissible to Central Goverment employees.

5) Fate of pay scales and pension including payscales ACP/MACP of these 11 categories in particular a cause of worry.  Matters unsettled due to objections.  The present speaking order in Core Professional's matter speaks it loud :   ARE THESE EMPLOYEES  STILL ENTITLED TO UPGRADED PAY SCALES...........DT.25.02.1999, that too, WHEN THE FACT IS THAT THIS ORDER NON-EST.

6)Prasar Bharati Board is defending the pay scales to these 11 categories and also recommending additional freebies arising out of these anomalies IN THE FORM OF ACP / MACP SAME WORK SAME PAY.......??

7) Ministry is certain and fixed to its stand that sec.11 is amended and there shall be no advantage of payscales arising out of earlier sec.11 where option was to be exercised.

8) Directorate is confused, it issues an order on the directions of MIB and later withdraws the same on the intervention of AFFECTED associations and Prasar Bharati.

9) Stations are pressurised to work and re-work again and again on fixations and also pension papers at the instances of PAOs

10) Those who have got the benefits want to retain them.  While those who have  do not have these benefits want it for them too. 

The tree yielding this fruit sec.11 has been trimmed.

Where does this situation now lead.........Time for all to see this.  I am sure this action will last for at least another 11 years by the time about 90% Deemed Deputationists would be gone.

We remain....but will the organisation!!!!!!!!!!!  Do we have any role??

ADASA CONVENTION HELD AT HYDERABAD



The 6th ADASA National convention  held at Hyderbad in a grand way on 27th & 28th November 2014.  Dr. Lakshmikant Bajipai, President of BJP,  Uttar Pradesh and  Brig(R) Vam Hussain, Principal Advisor (P&A) Prasar Bharati  attended the inaugural function.   Dr.Lakshmikant Bajpai & Brig.(R)VM Hussain have started the convention by lighting the lamp.  Sri G.K.Acharya in his presidential address appraised the problems faced by the administrative staff.  The frustration & humiliation faced by  administrative staff for not extending upgraded pay scale on par with other cadres is defeating the  moral of administrative staff and he urged the Principal Adviser Brig.(R)VM Hussain to initiate steps to put an end to the wage discrimination at the earliest.  Further he requested to take steps for implementation of CRC report. Shri V.Prasad, General Secretary  in his address, while expressing sincere thanks  to Prasar Bharati and both  Directorates for initiating steps to complete the DPC’s and conducting Departmental Exams on time stressed the need to extended the up-grated pay scales to Administrative Staff.  Dr.Lakshmikanth Bajpai in his address said that he was surprised to note how in an autonomous body like Prasar Bharati the working force is put to injustice and expressed solidarity for the demand of upgraded  pay scales on par with others working in Prasar Bharati.  Further, the very purpose of making AIR & DD autonomous is defeated as the governments are controlling the Prasar Bharati by arm twisting measures.  He make it very clear that the demand of Prasar Bharati scales to Administrative  Staff is a justified one and expressed his willingness to take up with Hon’ble MIB, if necessary.  He hoped that the Principal Advised Brig.(R)VM Hussain will immediately initiate steps in that way.  Brig.(R)VM Hussain has congratulated all the members for arranging convention which will be a platform to all members to express their views and difficulties by which  it will be very easy  for the management to make policy decisions keeping the staff welfare  in mind.  In regard to pay parity issue, he replied that Prasar Bharati has already recommended to MIB and the details of financial implications etc. have already been sent to MIB and requested Dr. Lakshmikanth Bajpai to impress up on the Hon’ble MIB Sri.Arun Jetly  as he is confident to convince  the Minister of State for MIB Sri.R.S.Rathode.  Brig.(R)VM Hussain  informed that all DPC’s are taking place on time and read the list of officials got promotions in result of recent DPC’s.  Shri.G.K.Acharya, Presedent expressed displeasure over the way Principal Adviser trying to through the responsibility on MIB initiating  steps for implementation.  Shri.P.V. Subrahmanyam has proposed vote of thanks.

Members aware that Hon'ble Principle Bench, New Delhi has given direction to consider the case of HC/Assistants with Grade Pay of Rs.4600 as given to Central Secretariat Staff.  At another case filed at Hon'ble CAT, Chennai Bench, arguments completed and Verdict reserved in OA No.824/2012  and the judgment is expected by next week.

ADASA, NC has requested all zones that ACRs of Assistants who are in draft eligibility list for promotion of Administrative Officer, may be sent to DG:AIR by 14th November.  DPC is likely to be held  between17th to 21st November and Promotion orders can be issued before this month end.  All the members are requested to see that ACRs should treach the Directorate by 14th of this Month.

PRINCIPLE BENCH JUDGEMENT ON GP 4600 TO HC/ASSISTANTS IN AIR & DD

  

REQUIRES YOUR SUPPORT TO FIGHT FOR HIERARCHICAL GRADE PAY ON MACP!!


Dear Members/friends,

You are aware that this Association has been pursuing the case of upgradation of Grade Pay of LDC & UDC for the last two years. The second most important issue which has been raised by us is the grant of MACP on Promotion hierarchy. This Association had put up the agenda for grant of MACP on promotional hierarchy in the National Secretariat meeting of the Confederation on 18/01/2010 which led the formation of a separate MACP Anomaly Committee. But the committee has not taken any fruitful decision to remove the hurdles in granting MACP on promotional hierarchy. Subsequently, individuals and Associations have filed cases in various courts for granting MACP on promotional hierarchy. And the dismissal of SLP filed by the DoPT against Shri Raj pal of CAT Chandigarh became the turning point on the issue.  In this connection, the cases come up for hearing so far has gone in favour of the employees. Principle CAT Delhi made historical judgments on the matter and asked the Government to implement its decision without any if and buts. CAT Guwhati, Chandigarh, Ernakulam  have delivered judgements in favour of employees and the High Court, Delhi, Ernakulam, Chandigarh have uphold the same.

According to the information available with us at present 4 SLPs are pending in the Supreme Court (1) SLP No. 10435 of 2014 UoI & Ors Vs Babu Ram & Ors (2) SLP No. 10436 of 2014 UoI & Ors Vs Dhirender Singh & Ors (3) SLP No. 21803/2014 UoI & Ors Vs M V Mohanan Nair and (4) SLP No. 22181/2014 UOI & Ors Vs Reeta Devi. The Basic demand of Shri Babu Ram & Dirender Singh were grant of MACP on promotional hierarchy whereas the nature  of the cases presented in the CAT by Shri M V Mohanan Nair & Ms Reeta Devi were something different than the demand for MACP on promotional hierarchy. Shri Mohanan Nair’s argument was that Rajpal, Ved Prakash & Mohanan Nair are photocopiers in different benches of CAT are borne in the same seniority list. Rajpal & Ved Prakash was granted pay hierarchy as per the provisions of ACP and as such parity may be given to him also. The argument of Smt Reeta Devi, who is holding an isolated post, was also something different than the argument of Babu Ram & Dhrender Singh.

We feel the SLP pending against Shri Babu Ram & Shri Dhirender Singh have direct relation with grant of MACP on promotional hierarchy. Details of the SLP related to Shri Babu Ram & Dhirender Singh are as follows:

Ordered to issue notice. And allowed stay on the operation of the order of High Court Chandigarh against which the SLP is filed.

U.O.I.   .Vs.   DHIRENDER SINGH & ORS.
According to information received to this Association, the case is converted to SLP (Civil) 23335/2014 and connected to SLP 23333 of 2014 i.e. with the case of Shri Babu Ram.
The SLP filed against Shri Babu Ram & others is treated to be the SLP filed against all the Central Government Employees who are fighting for grant of MACP on promotional hierarchy. And if Shri Babu Ram failed in this case, it may affect negatively to all Central Government Employees. In this contest I have contacted Shri Babu Ram & his colleague over phone and enquired reason for not engaging an advocate to defend his side on 22/8/2014. One of the colleagues of Shri Babu Ram has informed that the strength of the Ministerial Staff is less than 20 and Shri Babu Ram is working as UDC. And as such they are not in a position to spend as much money to appoint a competent advocate in the Supreme Court.

In the mean time, many of the viewers of this web site are in the opinion that individuals have limitations in contesting cases in Supreme Court. And the case will be ex-parte and in Government’s favour unless a capable advocate is got engaged by us.  Since the matter is related to raising funds, this Association is not willing to involve in it directly. 

In view of the above, all our friends are requested to give their valuable suggestions through comments, SMS, e-mail (e-mail aiams08@gmail.cometc. to combat the situation.  All the individuals/Associations who are conducting court cases on this subject are requested to perform decisive role in tracing a solution on the issue as soon as possible. Our friends in and around Chandigarh may please contact Shri Babu Ram and his colleagues at CAT Chandigarh to support them in tracing a final solution in the matter.

This letter is published in favour of all Central Government Employees as regards the grant of MACP on promotional hierarchy is concerned. Any difference of opinion on the interpretation of the court decision on the above cases may please be pointed out so that necessary correction may be made at our level.

ADASA PRESIDENT'S VISIT TO HYDERABAD







President, Shri G.K. Acharya visited Hyderabad on 2nd and 3rd of September 2014 to discuss about the National convention to be held at Hyderabad in November 2014.  Addressing the Members of DDK, Hyderabad Unit, the President informed the progress and steps initiated for achieving the upgraded Pay Scales.  He further informed about the Court Cases filed in regard to grant of Hierarchical Grade Pay, Case filed at Chandigarh etc.  Before addressing the AIR, Hyderabad Unit members he took part in the Zonal Council meeting and obtained the views of Zonal Council members for conducting the National convention in November 2014.

RETIREMENT OF SHRI PURUSHOTHAM REDDY, SAO, DDK, HYDERABAD






Shri Challa Purushotham Reddy, Sr.Administrative Officer working at Doordarshan Kendra, Hyderabad will be retiring from service on 31st August 2014.  Mr Reddy has served the organization for almost four decades in various capacities.  He joined All India Radio in 1974 as LDC and retiring as Sr.Administrative Officer on 31st August 2014.  He proved himself as an encyclopedia of rules and brought laurels to the stations where ever he worked.  His sincerity, devotion and dedication to the work and obedience to superiors is note worthy.  Staff worked under his supervision are really fortunate as he shows utmost patience in listening to the problems and for his positive approach in solving the problems.

ADASA wishes him a Happy, Healthy and Peaceful retired life.

ADASA NATIONAL COUNCIL MEET HELD AT NEW DELHI










The 29th National Council meeting of ADASA  held at New Delhi on 12th and 13th  of July 2014.  Representatives from various zones have attended the meeting. Several issues pertaining to Administrative cadre were discussed during the meeting.  Members attended from various zones have taken part in deliberations.  The issues of Pay Parity, Different court cases filed by ADASA and members,  in-situ promotions,  timely conduction of DPCs,  have come for discussions. However, Representatives have suggested the National Council  leaders to concentrate more on long pending issue of Pay Parity.  National council has assured to make all efforts to put forth the demands before concerned authorities. All the representatives have expressed their confidence with National Council and appreciated the efforts of National Council.   The meeting ended with vote of thanks.

ADASA PROPOSAL FOR IN-SITU PROMOTIONS

PROPOSAL FOR PERSONAL/IN-SITU PROMOTION OF   LDC IN THE  GRADE
OF UDC    AND   UDC IN THE GRADE OF HEAD CLERK/ASSISTANT
The issue of stagnation and promotion   in the Administrative Cadre has been raised by the Akashavani and Doordarshan Administrative Staff Association in the Office Council, Departmental Council as well as the meetings held with the officials in Prasar Bharati Sectt and Directorate General All India Radio so many times. The Lower Division Clerks and Upper Division Clerks working in the field units of All India Radio and Doordarshan have been stagnating  for a period of more than 20 years in the same post.
2.  Brief Background of  AIR & Doordarshan and Administrative
Cadre:-
(i) Background of AIR and Doordarshan
AIR:-
The broadcasting was started  in India before independence in 1923 and in later years after adopting it by the Govt it started working in the name of India State Broadcasting service in April, 1930 which was renamed  as All India Radio in 1936.  At present there are about 370 AIR Stations with more than 480 transmitters with having a reach within the   93% of population.
Doordarshan:-
In India the telecasting was started first time in the year 1959 from Delhi studio as a part of All India Radio having l television services in less than ten cities in India as a only one telecasting authority   but now there are 67 Programme Production centres ,40 satellite stations and more than 1415 transmitters with a reach of 93% of the population.
(ii)THE ADMINISTRATIVE STAFF STRUCTURE
In All India Radio and Doordarshan, at the Apex level there are Directorate of All India Radio and Doordarshan and at the field level there are about 370 AIR stations and 67 Doordarshan Kendras  & 480 Radio Transmitters  with 1415 Doordarshan Relay centers/Transmitters .  There are about 605 Drawing and Disbursing Officers working

in AIR and Doordarshan stations/Kendras/Offices and High Power Transmitters  in all over India where the day to day  Administrative and Financial works are to be carried out  for smooth working of the organization. The total no of  approx 40000 staff is working in  AIR and DDN having more than hundred cadres.  The  Administrative employees is having the sanctioned strength of 6209(Six thousand two hundred and nine) in the field units of AIR and DDn including few posts in DG:Doordarshan and DG: AIR and are performing the core functions in General Administration, Personnel and Financial Administration of the organization.

There are three distinct services on the regular establishment viz.(I)  Programme  (ii)  Engineering   (iii) Administrative.
The Administrative Staff of All India Radio and Doordarshan play a very important role in broadcasting by devoting their services in Programme, Engineering and Administration wings of Prasar Bharati.  Administration is the back of bone of any organization.  Administrative Staff manages the financial as well administrative wings  and  Store Department in  Prasar    Bharati. They perform the duties of an administrator and financial advisor in a Station/Kendra/Office of AIR and Doordarshan.
 Moreover with the conversion of AIR and Doordarshan into autonomous body (Prasar Bharati (India’s Public Service Broadcaster)  the method of book keeping has undergone a drastic change. Commercial accounting system has been introduced in tune with the changing needs of accounting and these calls for new skills among administrative employees and the work burden has also increased. The management of funds at the apex level as well as at the Station / Kendra / Offices shall be major task of Administration.
3.       Pay Parity /up gradation  OR  Prasar Bharati Secales Issue:-
Pay scales of 11 categories of Programme and Engineering Cadre of AIR and Doordarshan  were upgraded in the name of Prasar Bharati vide Ministry of I & B order No. 310/173/97-B(D) dated 25.02.1999  over and above the pay scale recommended by the 5th Pay Commission with the conditions/ undertaking that they will remain continue in Prasar Bharati . The Programme and Engineering Cadres are having more promotional avenues since  they are having  more than 50 percent Group A & B Gazetted posts  out of  the sanctioned Posts whereas in the Administrative cadre there are only 14 Group A and 147 Group “B” posts out of the  sanctioned strength of 6209 employees &  the LDCs and UDCs are stagnating for more than 20 years in one post .
But it is unfortunate to say  that the  pay parity case of Administrative wing has been totally ignored by the authorities since the last 15 years. The approach of the authorities  might have been  influenced by the wrong impression that since the designations of Administrative Staff of All India Radio and Doordarshan are similar to other Central Government Departments, the work / responsibilities shouldered by Administrative Staff of AIR and Doordarshan  and would also be the same but it is not the case.  The Prasar Bharati Secretariat  also comprises a Member for Personnel and  Member for Finance  as a full time functionaries is a sample proof of the significance and importance of these two wings i.e. Administration and Finance  of Akashvani And Doordarshan offices. The low paid employees LDCs  and UDCs  neither have a better chance of promotion nor  given the benefit of Prasar Bharati  upgraded  Pay Scales as per MIB order dated 25.02.199 referred above.

4 . NEED FOR IN-SITU PROMOTION FOR LDCS AND UDCS:-

It is a fact that  the Lower Division Clerks and Upper Division Clerks have been left stagnation for almost 20-24years due to one reason or the other.  The situation is so extraordinary that some extraordinary solution will have to be thought about to resolved their stagnation problems. The proposal for one time diversion of the Direct Recruitment posts in more than 100 nos of posts of Head Clerk/ Assistant  to promotion quota is also under consideration but it may not lasting the  solution to the long pending problem.

Lower Division Clerk  have been stagnating for more than 20years in the same posts. The promotion from  LDC to UDC takes  about 23 years.
The promotion from  Upper Division Clerk to Head Clerk  is also very delayed & they have been stagnating for more than 20 years.
The promotional prospects in the  administrative cadre  are very poor and most of the LDCs  gets only  one promotion in his service life span of more than 35 years.
5.     The following steps need to be taken in order to resolve the issue of stagnation for LDCs and UDCs:-

A ratio should be prescribed for seniority in the promoted cadre and this could be done on the basis of 3:1. 

6. PROPOSALS FOR CONSIDERATION:- 
(A) Lower Division Clerks:- 
(i)      In the Administrative cadre of AIR and Doordarshan,   the post  LDC is an entry level post (100 % Direct) in the pay band of Rs. 5200-20200/- with Grade Pay of Rs.1900/- and the  next post in the higher grade is UDC in the same pay band  but with the Grade Pay of Rs.2400/-. There are 3197 sanctioned posts of LDC in the entry grade  as against the higher post of 2222  in UDC grade.

(ii)     As per the Recruitment Rules, the post of UDC is to be filled up 80% by promotion and 20% through Departmental Competitive Examination.  The eligibility for appearing in the DE is five years regular service in the feeder cadre i.e. LDC.

(iii)     There is acute stagnation in the grade of LDC  as would be seen from the Seniority lists (Annexure-I to    ) In  the  LDC grade there are 1741 officials and all have completed more than 20 years  of service as on date as against the existing eligibility criteria of 5 years regular service .  This means that these officials have rendered for than 3-4 times of eligibility service.  These officials have, however got ACP/MACP and thus got the financial up-gradation.

(B)   Upper Division Clerk:- 
(i)      Similarly in the grade of UDC  most of the  officials have completed more than 15 years  of service as against the eligibility condition of  8 years  regular service in the grade of LDC. It means that they have also rendered about 2- to 3 times of service against the eligibility requirements for promotion to the post of Head Clerk/
Asstt.  In the Administrative cadre of AIR and Doordarshan, the post  UDC is promotional post in the pay band of Rs. 5200-20200/- with grade pay of Rs. 2400/-( 80% promotion and 20% Deptt. Exam.) The next post in the higher grade is Head Clerk/Assttt  in the  pay band of Rs. 9300-34800/- with Grade Pay of Rs. 4200/-. There are 2222 sanctioned posts of UDC   as against the higher post of 629  in  Head Clerk/ASStt  grade.
  (ii)     As per the Recruitment Rules, the post of  Head Clerk/Asstt  is to be filled up 60% by promotion,  20% through Departmental Competitive Examination and 20% Direct Recruitment .  The eligibility for appearing in the DE is five years regular service in the feeder cadre i.e. UDC 


(iii)     There is acute stagnation in the grade of UDC  as would be seen from the Seniority lists (Annexure-I to    ) In  the  UDC grade there are 1953 officials and all have completed more than 15-to  20 years  of service as on date as against the existing eligibility criteria of 5 years regular service. This means that these officials have rendered for than 3-4 times of eligibility service. These officials have, however got ACP/MACP and thus got the financial up-gradation.

 while visualizing the restructure   of  Administrative  cadre of All India Radio & Doordarshan  an approach vastly different to that of other government Departments should be adopted. The Cadre Review Committee has to study the structure and evaluate the working of the Administrative Cadre of AIR and Doordarshan from a different   perspective and angle as compared to  the  working of other Central Government Department.

Apart of the General and Personnel administration, in financial Management entire accounting functions are done by the administrative employees.  Keeping a watch over the payments to see whether the expenditure and payments are made according to rules and Ministries/Prasar Bharati Secretariat’s/Directorate’s instructions, accounting them and sending periodical returns to PAO, Prasar Bharati Secretariat & Directorate etc. , are done by the administrative employees.

         In view of the above facts,  the  LDCs and UDCs  who has been stagnating for more than 12 years  as done in the case of Pragramme Cadre needs  to be granted in-situ promotion immediately .
