Case was listed on 06.01.2011. Hon'ble Court has directed the Secretary and CEO to file supplementary affidavit within 6 weeks. The order issued by Hon'ble court is as below :

Heard the learned counsel for parties and perused the material on record.

We have carefully gone through the compliance affidavit of Shri S.K. Garg, Answering Respondent MIB dated 06-08-2010 and also the reply of the affidavit in support of the compliance affidavit filed by the applicant. By means of order dated 28.08.2008 passed by this Tribunal in O.A. No. 282/08 the respondents No. 1 and 2 i.e. Secretary and CEO, PB were directed to consider the claim of the applicant to extend the benefit of order dated 25.02.1999 for grant of higher scale than Rs. 4000-6000 w.e.f. 1.1.196 with all consequential benefits by treated this O.A. as the representation of the applicant and pass reasoned order within a period of three months form the date of receipt or supply of copy of this order. Concededly, the aforesaid order of this Tribunal has not been challenged either in the High Court or before the Apex Court. Though, in para 5 of the compliance affidavit sworn by Under Secretary MIB, it is mentioned that in compliance of the order passed by this Tribunal, the answering opposite party has duly considered the case of the applicant and the matter was referred to the GOM and it was required to be decided by MIB. Accordingly, it has to be referred to the GOM. In para 6, it said that the issue relating to disparity in pay scale of Administrative Categories and other ministerial cadres was considered by GOM in its meeting held on 17.06.2010 and they have decided th issue. In Para 7, it is said that in compliance of the order of this Tribunal dated 28.08.2008, after consider the matter, reasoned and speaking order dated 02.08.2010 has been passed in pursuance of decision of GOM taken in the meeting held on 17.06.2010. But the learned counsel for applicant point out that firstly, as would be apparent from the perusal of order dated 2.8.2010, instead of considering the case, it is mentioned that it has been decided that committee would not consider the issue regarding pay disparity of any Administrative categories of employees like LDC and UDC and other ministerial cadre as this would have wide ranging implication. He further points out that his Tribunal has director to respondent no. 1 and 2 to consider and pass well reasoned order. But this order dated 2.8.2010 has been passed by respondent no. 4, the Station Director. Moreover, minutes of the meeting held on 17.06.2010 of the GOM or any summary therefore has not been brought on record. Let therefore, a supplementary affidavit sworn by appropriate and proper authority be filed within 6 weeks. List on 24.02.2011. Let a copy to this order be supplied to both counsel as requested.

Member(Personnel) Shri Shivakumar said that "Prasar Bharati has formed an internal committee with DDGs and Managers under the chairmanship of Member(Personnel) which will look to all staff related matters and submit the report in a limited time to Prasar Bharati Board to take necessary steps. All the administrative issues will also be considered by the committee".


The Zonal convention of ADASA, Andhra Pradesh held at Hyderabad yesterday. Shri V. Shivakumar, Member Personnel of Prasar Bharati has attended as chief guest of the function. Smt M. Sailaja Suman, Director, Doordarshan, Hyderabad, Shri K.P. Srinivasan, Station Director, All India Radio, Shri N. Madhava Reddy and Shri Khramruddin Superintending Engineers of Doordarshan and All India Radio have attended the function. Satish Menon, State Secretary of ADASA has welcomed the guests. Sailaja Suman, Director of Doordarshan said that the demand of ADASA on pay scales is genuine. Shri K P Srinivasan, Station Director of All India Rado said that the employees should give their willingness whenever the employees are offered promotions. Shri Khamruddin, Superintending Engineer, All India Radio said that administrative employees are the back bone of organization. ADASA, Zonal Member V. Srinivas said, Prasar Bharati is only the department where LDCs are working as LDCs for more than 20 years without promotions. He asked the Member Personnel to make efforts to implement the order of 1999 on Pay Scales to administrative staff also. He also said that the members from other associations should also be nominated in the committee which is formed on Prasar Bharati Act and said ADASA along with 14 associations opposing any amendment in Prasar Bharati Act and demanding to implement the PB Act without any modifications. Senior Member Naga Raju said that all the existing vacancies of Admin Staff in Prasar Bharati should be filled up on promotions with one time exemption which benefits the employees and also to avoid the abolishan of posts. He also pointed out the delay in Departmental Exams and MACPs. Shri Sivakumar in his address explained that how the issue of Pay Parity is moved from different points. He said that report on Pay scales by subcommittee is prepared and submitted to GOM which is in favour of employees. He assured the members that, if any thing is to be recommended on Prasar Bharati Act by the committee, that will be done only after consultation of all leftover cadres. On the point raised by Naga Raju on filling up of vacancies, the Member Personnel said that he will see the possibilities and asked the members to send the proposal. A souvenir from ADASA has been released by Member Personnel. Apart from the members of AIR & DDK, Hyderabad, members from major units in AP have also attended the meeting. The convention ended with vote of thanks by Suresh.

Information and Broadcasting Minister Smt Ambika Soni Tuesday called for 'a fresh start' and announced that the government was considering a new roadmap to energize Prasar Bharti. The government was considering a new roadmap for taking new initiatives in the Prasar Bharti setup, Soni said at function here to release DVDs of Doordarshan Archives. The initiatives would aim to firm up the mandate given to Prasar Bharti Corporation as a public broadcaster in the country, she said. She also assured the employees of Prasar Bharti that issues concerning them would be looked into, and called upon them to make a resolve to initiate a fresh start during the new year. Soni launched a set of DVDs, including Paintings of India, Path-breaking Dancer Sonal Mansingh and Secrets of Shastras revealed by Gurus. The minister stressed upon an urgent need to centralize cataloguing, assimilation, preservation and restoration processes. The method of disseminating archival information through popular mediums such as DVDs provided an entertaining tool and platform to ensure the continuity of cultures across different generations, she said.

According to a decision taken at the Prasar Bharti Board meeting, Shri Takru, who is the Additional Secretary in the Information and Broadcasting Ministry, would be the officiating CEO for the interim period till an inquiry against Shri Lalli ordered by the Supreme Court is completed. The Board resolved that Takru, who is a nominated member of the board, "may exercise all such powers and discharge all such functions vested with the Chief Executive Officer until further directions of the board and work continually under the overall direction, control and supervision of the Chairperson," a press statement said. Takru, an IAS officer of 1979 batch, has earlier served as Director General of National Institute of Fashion Technology (NIFT) under the Ministry of Textiles. With an aim of streamlining the functioning of the national broadcaster, the Board also formed five committees dealing with the subjects of finance, personnel, production and content, project monitoring and implementation and strategy and vision, said the statement issued by the Chairman's office.


The Prasar Bharati Board will meet today to appoint a senior information and broadcasting ministry official as its acting chief executive officer. There are multiple issues to be sorted out. Appointing an acting CEO is the first priority. And many issues relating to administration, finance, employee strength, and protests by workers have been on hold for too long. They are all on the agenda for Monday’s meeting,” a senior government functionary told reporters on Sunday. Doordarshan and All India Radio employees threaten strike every month. PB is short-staffed all over. There is systemic rot that will have to be addressed,” a PB member said.
