"WE DO NOT WANT TO TAMPER WITH THE PB ACT" MADAM SONI

The Information and Broadcasting Ministry is considering of amendments to the Prasar Bharti Act to make it "conducive" for better functioning of the public broadcaster without tampering with the spirit of the autonomy of the legislation. "We do not want to tamper with the Act," Information and Broadcasting Minister Ambika Soni told reporters that "we would like to make the act as healthy and as conducive to a public broadcaster as possible." Soni said that the Group of Ministers on Prasar Bharti, headed by Home Minister P Chidambaram, would be presented with the proposed amendments. The Information and Broadcasting Secretary was given three to four months to look at some amendments and he would be formulating his report shortly, she said. Sources in the ministry said that the amendments would also look at the employee problems of the public broadcaster like payment of salaries and promotions. A proposal might be put forward before the GoM of the I and B Ministry taking over the payment of salaries and dues and splitting into half with the public broadcaster the other costs recurred. The sources said that nobody has been appointed to replace Lalli as he has not been removed but only suspended pending inquiry.

ADEF MEETING HELD ON 16TH DECEMBER

The meeting of Akashvani & Doordarshan Employees Federation was held on 16th December at DDK, New Delhi. It was scheduled to meet on 17th of December but was preponed to 16th of December. The members from 13 associations have attended the meeting. It was proposed to strengthen the Federation to bring all the leftover categories on the same platform. It was also proposed to elect the new Office Bears for Federation.

'DISPARITIES IN PAY SCALES NEED TO BE LOOKED INTO" JPC

Standing Committee on Information Technology has submitted its report on Ministry of Information & Broadcasting on 10.12.2010 in Lok Sabha. The committee has observed some vital points on pay anomalies of staff. "With regard to the disparities in the pay scales of common administrative categories of employees like LDCs, UDCs and other Ministerial Cadres, the Committee have been informed that the Group of Ministers has already taken a view that the pay scales of the said employees would not be looked into in view of the wide ranging implications. The Committee note from the information furnished by Prasar Bharati that out of the sanctioned strength of 48173 employees, 17382 employees are from the administration wing. The issues related to disparities in the pay scales of such a high number of employees also need to be looked into. As such the Committee urge the Government to devise some mechanism to address the issues related to disparities on the lines of the mechanism of Group of Joint Secretaries for other categories"

FPBE consisting of 15 associations of Doordarshan Kendra, Hyderabad and All India Radio Hyderabad have decided, not to take part in the agitation call given by certain cadres of Employees of Prasar Bharati from 13th o December. Shri K. Heerala, Convenor of FPBE has written a letter to the Superintendent Engineer of DDK, Hyderabad stating that the members of 15 constituent association of FPBE will not take part in the agitation and reiterated its stand on Prasar Bharati Act, and extended its fullest support in case of emergency.

ARMY TO RUN AIR & DD?

With an indefinite strike by certain cadres of employees of public broadcaster Prasar Bharati looks imminent, the government is planning to rope in Army personnel to man the stations of All India Radio and Doordarshan to ensure uninterrupted services. A Section of employees of Prasar Bharati may go on an indefinite strike from December 13, as the employees union, have not been addressed so far, the strike will begin on December 13. "A GoM which was scheduled to meet on Tuesday is not meeting now. However, government officials are confident that there will not be any strike. "We feel that the matter will be resolved within this week and there will not be any strike," sources in the I&B ministry said.

The main problem, according to the NFADE, is delayed salary disbursal. Currently, the salary for Doordarshan and AIR employees comes from the reserve fund of Prasar Bharati via the grant-in-aid received from the government. "Officials say there is no money in the reserve fund and that is why salaries are delayed," a senior AIR employee said. However, as part of the solution to prevent the strike, the government is working on a proposal to fix the disbursal of delayed salaries. "This is a proposal whereby Prasar Bharati employees will get their salaries without delay directly from the consolidated fund of India," a government source said. However the NFADE is not convinced and has called for the involvement of the I&B ministry. I&B ministry says it can not directly involve itself in Prasar Bharati as it is an autonomous body.

"The demand for repeal of the Prasar Bharati act was put before the GoM earlier. However, even the GoM did not take up the issue as it found it to be outside its purview," sources in the I&B ministry said.

RETIREMENT OF SHRI N PREM KUMAR, ZONAL CHAIRMAN OF ADASA










Andhra Pradesh Zonal Chairman of Akashvani & Doordarshan Administrative Staff Association Shri N. Prem Kumar will be retiring from service on superannuation on 30th November 2010. He has joined the service as CG.II on 12.09.1973 at AIR, Hyderabad and promoted as CG.I on 24.04.1984 at CCW, AIR, Hyderabad. Again he has been promoted on 29.01.1998 as Accountant at AIR, Adilabad. He has been transferred to DDK, Hyderabad on 17.02.2003. He has rendered so much of service to ADASA as Chairman. All the members of ADASA whish him a happy and peaceful retired life.

2. It may also be added that the administrative cadre employees of AIR and Doordarshan have been seeking parity with the Central Secretariat cadre. With the implementation of recommendations of the 5th Central Pay Commission w.e.f. 1.1.1996 the two Scales became equal. However, the pay scale for CSS cadre Assistant was revised to Rs.6500-10500 w.e.f. 15.9.2006 though the pay scale of Head Clerk/Assistant has remained Rs.5500-9000. The other relevant information is that the Assistants of CSS cadre are classified as Group B (Non-Gazetted) whereas the Head Clerks/Assistants of GCS Cadre i.e. AIR and Doordarshan have been classified as Group C.

3. The Akashvani & Doordarshan Administrative Staff Association (ADASA) has given a call for holding Gherao/Dharna w.e.f. 11th November, 2010. After discussions with the officers of this Directorate, they have submitted written submissions in support of their demands. A copy of the same is enclosed.

In view of the agitation call given by the ADASA, the Ministry of I&B is requested to take immediate action on the issue so that the situation is resolved at the earliest.

2. This Directorate has submitted its Action Taken report on the minutes of the meeting held on 19.8.2010 by CEO, Prasar Bharati with the representatives of ADASA. A copy of the same is enclosed.

3. DDG(A) held a meeting with the representatives of ADASA on 8.11.2010 and detailed the sincere efforts being made by this Directorate to resolve the issues related to the administrative cadre employees of AIR & Doordarshan. In the presence of your representatives, DDG(A) discussed on phone with Ms. Jayanthi, DS(BA-P), Ministry of I&B, the issue of grant of grade pay of Rs.4600 to Head Clerk/ Assistant and Rs.5400 to Sr. A.O./ IA. An assurance was given by her that a positive reply, with the concurrence of DOP&T, Dept. of Expenditure, will be given by the Ministry very soon.

4. The issue of holding Departmental examination for administrative cadre employees was also discussed by DDG(A) with DDG(P) and GM(P), Prasar Bharati during the course of the meeting and a positive action was assured. Various other issues were raised by you and other representatives of ADASA and they were discussed thread-bare.

5. It may not be out of place to mention here that this Directorate has all along extended its wholehearted support to the Association and its members and as such the call for agitation given by the Association is unfortunate and uncalled for at this juncture. As such, you are requested to reconsider and withdraw your proposed agitation.

A NAKED TRUTH

All employees associations will be cooperative with each other. They may have some differences in their agenda, but they move forward at critical times. If we take the example of Bank Associations and Insurance associations, If Bank associations are going for an agitation, the associations of Insurance will express their solidarity. But the case of Prasar Bharati is entirely different. Certain categories of employees are granted higher scales on the name of Prasar Bharati. Till then the left over cadres are demanding for implementation of same order and making all efforts through agitations, courts. The Elder Brothers who got the benefits, instead of extending support, they have issued a notice to government which is placed here. The content is

“WE WILL BE COMPELLED TO GO ON AGITATION WITHOUT NOTICE UNDER THE FOLLOWING CIRCUMSTANCES: IN CASE OF PAY REVISION OF ANY CADRE IN ISOLATION WITHOUT CONSIDERING ALL THE CATEGORIES OF AIR & DD, INCLUDING THE EMPLOYEES REPRESENTED BY THE CONSTITUENTS OF NFADE”

Our elder brother is granted scales in isolation leaving other cadres. Individual Associations are fighting for the higher scales. Being Elder Brother of all associations and said to be representing 21 associations, Elder Brother can demand higher scales to left over categories. But Elder Brother clarified at Hyderabad that his agenda is only “Repeal Prasar Bharati” and no other demand will be taken up by him. Neither he will take up the demand nor he will allow to get the higher scales by individual associations. What may be his intention? Can any one tell? And it is also a surprise that being a representative of 21 associations called for negotiations by the government , Elder Brother did not attend the meeting with Joint Secretaries which is constituted for consideration of higher scales to left over categories of Prasar Bharati. What may be the reason?

MY INNOCENT FRIEND

The wife asked his husband to highlight her importance “If I would not have born, whom would you marry?”. Husband immediately replied “ Your mother”. If both are equally intellectuals, there will not be any problem. If any one of the two is innocent in a team, the other one starts playing. The same thing is happening in Prasar Bharati. One of my friends said "because of the ELDER BROTHER, the employees are getting salaries in AIR & Doordarshan". I asked him “Is your Elder Brother giving from his pocket?” . My friend replied”NO No NO…because of the efforts of Elder Brother, we are getting salaries”. He also said ”Only because of Elder Brother, We are enjoying all government benefits like sixth pay commission, CGHS, Government Accommodation, KV and so many”. I asked him “ Are you a government servant or not?” My friend “ Definitely, I am a government servant” Then I said “ All these problems are for the employees who have been drawing corporation scales. If you would not get the Pay Commission scales, you would have got the corporation scales. But your elder brother got double bonanza of corporation scales as well as Pay Commission benefits. But what about you?” My Friend said “See.. if CGHS facility is stopped, imagine the situation". I said “ I can imagine, nothing will happen. Insurance coverage will be provided to all employees. Even government is also thinking to stop the CGHS facility” My friend said “ OK. If government accommodation is not provided, where can we stay in cities?” I smiled and said “ See my friend.. there are so many staff quarters constructed for the staff of AIR & DD in all states. I don’t think there will be problem” My friend raised his voice and said “ see if Kendriya vidyala has denied admission to our children, where will our children go for studies?”. I really annoyed and said. “See my dear friend, in how may places Kendriya vidyalayas are there? all these problems are the problems of your Elder Brother at Delhi. The employees staying in zones are not having these problems. Your Elder Brother"s problem is a national problem. But he least bothers of your problem. You have no promotion for twenty years. No recruitment in your cadre for ten years. Vacancies are getting abolished. No other benefits even though working for a corporation. But your Elder Brother is getting promotion for every six years, granted Corporation Scales, again another hike with Pay commission on corporation scales, recruitment for every year in their cadre. Behind all these things, the support of paid servants like you is also there to threaten the government and to fulfill his demands.” Even then my friend is not convinced. He said “My Elder Brother told me that I will loose my job”. I really felt and told him “ Oh..you alone is working two or three employees work. Your people are lesser than the actual requirement, unlike your Elder Brother. They are trying to frighten you on the name of corporation just to keep you in his control. Believe me”. My friend shook my hands and said “You are right”.

Incentive system for Govt staffers next year…!

Central Government has introduced accountability across the board with setting up performance targets and top level officers agreeing that upto 40 per cent of their salaries will be placed with in two months, dependent upon level of performance for which self-evaluation process has been evolved, Dr. Prajapati Trivedi, Secretary, Performance Management Division, Cabinet Secretariat revealed here today. Stating that the system change in the central government would enable measurable response to public grievance by government officials, Dr. Trivedi declared.

Inaugurating ASSOCHAM organized 2nd CFOs Roundtable Conference 2010 here today, Dr. Trivedi also indicated that all 62 government ministries and departments on board have signed the tool called Results Framework Document (RFD) which will set targets for each ministry and will finally be the basis for yearly evaluation. “Results will be our bottom-line just like profits are the bottom-line of the private sector” he pointed out.

The formula of assessing the government employees as proposed by performance management division under the cabinet secretariat, has ruled out “not me syndrome and passing the buck”. The Secretaries in turn will have to set performance levels for the officers below them and evaluation would be from bottom to top. “Once we fix the performance deficit, other things will follow” Dr. Trivedi said elaborating on the causes of performance deficit. He told the audience that had leading private sector CFOs that “private sector will look up to us”.

The Cabinet Secretariat also said that the first round of assessment, initially for three months from January to March 2010, there is a strong possibility that a large number of government employees would receive an extra pay once the new formula is adopted. He also mentioned that the government is extending the performance monitoring and evaluation system to 62 departments from the current fiscal. According to our system, a department sets a target, fixes the weightages of each target, and if it succeeds meeting all its targets, gets a score of 100.

He also highlighted that many countries such as Canada, New Zealand, Australia, Netherlands, Denmark, UK, US and Finland have moved away from the traditional government administrative model to a management model under which officers act like corporate managers as they get greater operational freedom, but are held accountable for results. In fact, New Zealand is considered to be the leader of the pack where performances of government agencies are weighed in by setting targets and adopting regular evaluations. “In New Zealand the Governor of the central bank has his salary linked to inflation level being low and as a result for the last 18 years that country had a low inflation level,” he disclosed.

The various ministries and departments are preparing their Result Framework Documents (RFD) which is to be submitted to this division and the performance of the ministries will be monitored based on these documents only. First, the ministries are themselves setting their targets and secondly they have huge manpower ranging from senior bureaucrats to employees under central secretariat scheme (CSS).

The Government has already established a performance management division within the cabinet secretariat headed by a professional. So, the performance of central ministries is under close watch. By introducing performance-linked payouts, the Indian government is finally going the corporate way which may force central government employees to deliver their best.

NEW DELHI: An incentive structure akin to one prevalent in private sector could soon be in place for government servants as well, building on the extensive performance review that is already underway for them, a top government official said. “An incentive system is being worked upon as recommended by the sixth pay commission. It could be implemented by next year,” Prajapati Trivedi, secretary, performance management, said at the annual economic editors’ conference.

The incentives would be given out from the cost savings achieved by a bureaucrat in his role and will, therefore, not place an additional financial burden on the government, he explained. Besides, the extensive job performance parameters, these incentives would also depend on cost saving on account of reduction in the use of office stationary and savings in electricity consumption. Cabinet secretary K M Chandrasekhar has already written a letter to all secretaries to the government of India on their performance targets.
A mid-year review of the performance of government departments and officials is currently underway, that will give them fair idea of how each fare with respect to their agreed goals. The government had put in place a performance monitoring and evaluation system following an announcement in this regard by the President in her address to both the houses of Parliament on June 4, 2009. The first evaluation was carried out last year which was limited to only three months of the fiscal.

The current year’s evaluation would be the first comprehensive exercise, which will be illustrated in a report card. This report card will be finalised by May 1 each year. The new policy is designed on what is already in place in many countries. New Zealand, United Kingdom and USA carry out extensive performance reviews of their government departments.

The results framework document of each ministry or department will be put on its website to ensure stakeholder participation and transparency of the exercises. The concept is based on a paper prepared by the IIM, Ahmedabad.

Twelve associations of Prasar Bharati Employees have decided to form a federation to fight for their legitimate demand of Pay Scales as granted to certain categories of employees working in Prasar Bharati. Delegates from Camera Men Welfare Association, Stenographers Association, Administrative Staff Association, Group D Union, Drivers Association, Carpenters & Painters Association, Rajbhasha Employees Association, Makeup men Association, Graphic Artists Association, Video Editors Association, News Casters Association and Library Information Assistants Association have participated in the meeting. Grup D Union has already extended support to the FPBE (Federation of Prasar Bharati Employees) at National level and Camera Men Welfare Association and Drivers Association have extended its support. Other Associations are getting ready for new equations and Aakashvani Announcers Association Rajsthan Zone has announced that they have withdrawn support to NFADE and expressed their willingness to join the FPBE. All the delegates have decided to strengthen the federation at National level to show their strength of 20,000 employees working for Prasar Bharati. The delegates have objected the words of certain associations who are demanding to repeal Prasar Bharati are creating rumors that the future of Prasar Bharati is in doldrums. The delegates said it is a surprise that the employees who are benefited from corporation and enjoying higher scales on the name of Prasar Bharati, are now demanding for repeal Prasar Bharati. All the delegates have decided to extend all sorts of co-operation to the government and extend their support for continuation of Prasar Bharati.

GOVT EMPLOYEES CAN PROTEST ADVERSE ACRs

Government employees cannot be denied the opportunity to appeal against adverse Annual Confidential Reports (ACRs), on the grounds that such reports would not be ignored while considering them for promotion, the Delhi High Court has ruled. A bench of Justice Pradeep Nandrajog and Justice MC Garg reversed the Central Administrative Tribunal's (CAT) directive to a departmental promotion committee to ignore the adverse ACRs of five Indian Revenue Service (IRS) officers while considering them for promotion. The order came on five petitions filed by the Centre against the CAT's orders asking that some ACRs be ignored, while considering IRS officers Krishna Mohan Dixit, K. Hari Prasad Rao, R. Bala Naik, Devinder Singh Choudhary, Ravindra Kumar Rai for promotion. The CAT wanted the adverse ACRs (below benchmark of "very good") to be ignored, as they were not communicated to the IRS officers in question at the relevant time. Some of the ACRs were three years old at the time of holding the committee and could not be taken into account in view of the May 11, 1990, Memorandum of the Department of Personnel and Training (DoPT). The CAT said there was no point in making any representation in view of the retirement of reporting and reviewing officers. However, after analysing the Supreme Court judgments in the cases of UP Jal Nigam, Dev Dutt and Avijit Ghosh Dastidar, the HC said: "The question of ignoring adverse ACRs instead of giving a chance of making representation does not arise." The Bench said, "All ACRs are to be communicated to the incumbent." It said in the case of ACRs being below the benchmark, the affected person could make a representation that would be considered by the relevant authorit, which would be superior to the authority, which gave the adverse ACR. The high court said the May 11, 1990 DoPT Memorandum, was issued before the recent SC rulings. A new memorandum has already been issued on April 13, 2010, which made it mandatory to communicate to the employee an adverse ACR.
